Repair & Customization Terms and Conditions

Haynes Creek Gunworks (HCG) will attempt to repair your firearm as described and for the charges shown on your estimate or invoice form unless such charges are revised with your oral or written consent as described below. Repairs and modifications are not always possible. Should your product be unrepairable, a minimum charge of $59 will be applied.

Under no circumstances will any work be performed that might render the firearm illegal, outside regulatory guidelines, or unsafe. We do not work on any firearm produced after the enactment of the Gun Control Act of 1968 which does not have a serial number. This includes “80% receivers” or any other example.

HCG does not provide manufacturers’ or 3rd party vendor warranty repairs.

Workmanship

Haynes Creek Gunworks warrants that the repairs or customizations will be performed in a competent and workmanlike manner. HCG may use new, used, or reconditioned (refurbished/pre-owned) parts.

All parts used to repair your product will be free from defects in materials and workmanship for thirty (30) days unless otherwise specified by HCG. HCG may subcontract with other service providers for the repair or modification of your product.

Repairs and Customization

Repairs to the firearm will be to return the firearm to operation at the level of performance expected for a firearm of that make, age, and condition. HCG will exercise reasonable care to maintain the safety of the firearm. No modification to the safety features of the firearm will be made that might impede their normal function.

Customizations made at the request of the customer may not be suitable for the intended purpose of the firearm. Repairs and modifications may affect the accuracy, precision, and reliability of the firearm in unpredictable ways. HCG makes no warranty regarding suitability for any purpose or the accuracy, precision, and reliability of the firearm.

You are wholly responsible for the use, misuse, safety, and care, of the firearm and accept all responsibility for any direct or consequential damages resulting from the use or misuse of the firearm, or for any injury that may occur. You hereby release Haynes Creek Gunworks from any loss, liability, or claim caused by or in connection with the firearm. You understand that the only warranties cover labor costs for repairs that are performed by HCG and no other warranties are expressed or implied.

Repair Fees

Haynes Creek Gunworks will provide repair estimates for firearm repair and modification only after examining your firearm. A minimum diagnostic fee of $59 will be applied to all repairs at our discretion. This fee will be applied to the labor charges in the final invoice.

If the repairs require labor and/or parts not specified on your estimate receipt, HCG may seek your approval of a revised estimate. If you do not agree to the revised charges, HCG will return your product upon payment of the diagnostic and all labor fees for the work performed, plus any applicable taxes.

Deposits

Some repairs and modifications require a deposit before ordering parts or starting a project. All deposits are non-refundable unless the project is terminated before any purchases or work has begun. In this case, a minimum fee of $59 will apply. The deposit will be applied to your final invoice once the project is completed.

In some cases, after collecting the deposit, parts might become unavailable or updated by the vendor. HCG will provide substitute parts, when available and appropriate, and may revise the estimated costs to the customer as described in the section “Revised Estimates”.

Payments

Haynes Creek Gunworks accepts cash, checks, credit and debit cards, and other online transfer payments at our discretion. Any fees associated with any payment type may be passed on to the customer. All payments except for required deposits are due after the repair is completed and before picking up your firearm. Payment processing fees are non-refundable.

Abandoned Items

If you have not claimed your product and have not paid all charges due within thirty (30) days after being notified by Haynes Creek Gunworks that your product has been repaired, HCG will consider your product abandoned. HCG will provide such notice to you at the email or postal address you furnished when you authorized the repairs. HCG may dispose of your product in accordance with applicable provisions of law, and, specifically, may sell your product at a private or public sale without liability to you. HCG reserves all statutory and any other lawful liens for unpaid charges.

Haynes Creek Gunworks Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAYNES CREEK GUNWORKS AND AFFILIATES, WILL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE PERFORMANCE OF ANY REPAIR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS. IF ANY PRODUCT SHOULD BE DAMAGED OR LOST WHILE IN HAYNES CREEK GUNWORKS CUSTODY, HAYNES CREEK GUNWORKS LIABILITY WILL BE LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE AFFECTED PART. HAYNES CREEK GUNWORKS MAKES NO REPRESENTATION THAT CUSTOMER-PROVIDED ACCESSORIES ARE SUITABLE FOR THE PURPOSES INTENDED.
